Que la aplicación de nuevas tecnologías y productos derivados de los huevos, imponen la actualización y adecuación de la normativa reglamentaria. Que los establecimientos elaboradores de huevo líquido, congelado y/o deshidratado, como así también los destinados a acopio, depósito, clasificación y envasado, reúnen características singulares y propias que hacen necesario independizarlos de la actual asimilación con las fábricas de Chacinados. Que el suscripto es competente para resolver en esta instancia, en virtud de la delegación de funciones acordadas mediante el decreto n° 2.551 de fecha 30 de diciembre de 1986. Por ello, EL SECRETARIO DE AGRICULTURA, GANADERIA Y PESCA RESUELVE: ARTICULO 1°.- Aprobar como Capítulo XXII del Reglamento de Inspección de Productos, Subproductos y Derivados de Origen Animal el Anexo I que forma parte integrante de la presente resolución. Ver Resolución ex SAG Nº 70/82, Decreto 2712/79. BUENOS AIRES, 21 de diciembre de 1984 VISTO la Resolución Nº 70/82 reglamentaria del Decreto Nº 2712 y, CONSIDERANDO: Que el servicio de apoyo a la fiscalización oficial de manzanas y peras con destino a la exportación a cargo de profesionales ingenieros agrónomos de la actividad privada constituye el fundamento básico del sistema impuesto por ese instrumento legal. Que no obstante el tiempo transcurrido desde la puesta en vigencia del mencionado servicio, aún subsisten ciertas diferencias en su accionar que necesariamente deben ser superadas. Que en consecuencia resulta prioritario encauzar el mismo, de modo de asegurar el cumplimiento de la función encomendada a los citados profesionales. Que conforme a lo establecido en el Artículo 11 del mencionado decreto, esta Secretaría se halla facultada para dictar el presente acto. Por ello, EL SECRETARIO DE AGRICULTURA Y GANADERIA RESUELVE: ARTICULO 1º.- Constitúyese en el ámbito de la Dirección Nacional de Fiscalización y Comercialización Agrícola de esta dependencia, el Comité Profesional de asesorar al citado organismo en lo concerniente a: - Evaluación del desempeño de los ingenieros agrónomos de la actividad privada en la certificación de la sanidad de manzanas y peras destinadas a la exportación, de acuerdo a lo establecido en la Resolución Nº 70 del 23 de febrero de 1982 que reglamenta al Decreto Nº 2712 del 23 de octubre de 1979. - Determinación de las altas y bajas de los nombrados profesionales del Registro respectivo. - Coordinación de los cursos de capacitación previstos en el artículo 12 de la mencionada resolución y de actualización técnica de dichos profesionales. ARTICULO 2º.- El Comité Profesional de Evaluación estará integrado por Dos (2) representantes de la Dirección Nacional de Fiscalización y Comercialización Agrícola y Uno (1) a propuesta del Consejo Profesional de Ingeniería Agronómica (Ley Nº 14.467; Decreto Ley Nº 6070/58. BUENOS AIRES, 28 de setiembre de 1984 VISTO el expediente N° 3644/84 en el cual el SERVICIO DE LUCHAS SANITARIAS (SELSA), dependiente del SERVICIO NACIONAL DE SANIDAD ANIMAL (SENASA) propicia incorporar la Rinitis Atrófica del Cerdo al grupo de enfermedades que deben ser combatidas con carácter obligatorio, y CONSIDERANDO: Que las investigaciones realizadas en el SERVICIO DE LABORATORIOS (SELAB) dependiente del SERVICIO NACIONAL DE SANIDAD ANIMAL (SENASA) posibilitan el diagnóstico de la Rinitis Atrófica del Cerdo sin lugar a dudas. Que se trata de una noxa potencialmente de sumo riesgo ya que puede causar cuantiosas pérdidas a la porcinocultura y por consecuencia, atenta contra la política nacional de carnes, los objetivos de diversificación de la producción y el consumo de proteínas de origen animal. Que de asumir carácter epizoótico puede provocar disminución en las exportaciones de carnes, con los consiguientes perjuicios económicos para el país. Que esta resolución cuenta con el aval de la Comisión Conjunta Asesora de la Subsecretaría de Ganadería para la especie porcina. Que la inclusión de que se trata, se efectúa de conformidad con las facultades otorgadas por los arts. 1° y 2° del Decreto N° 481 del 20 de abril de 1971. Por ello EL SECRETARIO DE AGRICULTURA Y GANADERIA RESUELVE: ARTICULO 1°.- Incorpórase al grupo de enfermedades a que se refiere el artículo 6° del Reglamento General de Policía Sanitaria de los Animales, de fecha 8 de noviembre de 1906 (Ley N° 3959), a la Rinitis Atrófica del Cerdo. ARTICULO 2°.- Declárase obligatoria la denuncia inmediata de la aparición, existencia o sospecha de la Rinitis Atrófica del Cerdo en animales alojados en establecimientos ganaderos; concentrados en locales de expedición o venta y/o en tránsito por caminos públicos; la que deberá ser efectuada a la autoridad cercana del SERVICIO DE LUCHAS SANITARIAS (SELSA),. ARTICULO 3°.- El SERVICIO DE LUCHAS SANITARIAS (SELSA), establecerá las medidas a tomar con respecto a los animales enfermos pudiendo disponer, cuando razones de orden profiláctico lo exijan, el sacrificio de los animales, la desinfección y desinsectización de las instalaciones y áreas de influencia y destrucción de sus despojos, como así también de todos los elementos que pudieran ser vehículo de contagio. ARTICULO 4°.- Prohíbese movilizar o extraer animales del establecimiento, fracción o lote donde existe o se sospeche la existencia de Rinitis Atrófica del Cerdo sin la autorización previa del SERVICIO DE LUCHAS SANITARIAS. �ARTICULO 5°.- La declaración de infección de Rinitis Atrófica del Cerdo en zonas, establecimientos ganaderos o locales de concentración de animales, será dejada sin efecto dentro de los plazos y condiciones que determinará el SERVICIO DE LUCHAS SANITARIAS (SELSA). ARTICULO 6°.- En caso de oposición o resistencia por parte de los responsables a lo dispuesto por la presente resolución, el personal interviniente del SERVICIO DE LUCHAS SANITARIAS (SELSA), dará intervención a la fuerza pública al sólo efecto de allanar los establecimientos o locales en los que sea preciso adoptar algunas de las medidas prescriptas precedentemente. ARTICULO 7°.- El SERVICIO NACIONAL DE SANIDAD ANIMAL (SENASA) queda facultado para dictar las normas técnicas complementarias que correspondan para el mejor cumplimiento de las medidas sanitarias, tendientes al control y/o erradicación de la enfermedad. ARTICULO 8°.- Las infracciones a la presente resolución serán penadas conforme a lo previsto en la Ley N° 22.401.
