52 10 4136 https://biblioteca.senasa.gov.ar/files/original/526bfee57f5069606711b3265c371956.pdf b7679f6217855c82700fb2dcf8cd983f PDF Text Text DISPOSICION N° 46/2017 DNAPVyA BUENOS AIRES, 25 de enero de 2017 VISTO el Expediente N° 13910/1998 del SERVICIO NACIONAL DE SANIDAD Y CALIDAD AGROALIMENTARIA, y CONSIDERANDO: Que la firma REOPEN S.A. se encuentra inscripta en el Registro Nacional que determina el Artículo 1° del Decreto N° 583 del 31 de enero de 1967, modificado por los Decretos Nros. 3899 del 22 de junio de 1972 y 35 del 11 de enero de 1988, reglamentario de la Ley N° 13.636; y la Resolución N° 345 del 6 de abril de 1994 del ex-SERVICIO NACIONAL DE SANIDAD ANIMAL, como Elaboradora, Fraccionadora, Distribuidora Importadora y Exportadora de productos de uso en medicina veterinaria. Que para desarrollar dichas actividades, la mencionada firma posee un establecimiento con número de habilitación 8489 sito en la calle Río Derey entre Río Pinto y Río Potrero, General Rodríguez, Provincia de Buenos Aires. Que con fecha 09 de enero del corriente año, se llevó a cabo una auditoria a los efectos de constatar el cumplimiento de la legislación vigente. Que en la mencionada inspección, no se pudo acceder a documentación que permita constatar la correcta elaboración de Productos Veterinarios. Que el establecimiento auditado no reúne las condiciones edilicias necesarias para la elaboración de Productos Veterinarios. Que posee instalaciones dedicadas a elaborar caravanas ectoparisiticidas y no posee una habilitación para ello. Que el incumplimiento de la norma detallada no permite garantizar al consumidor la calidad de los productos que recibe. Que por ello corresponde suspender preventivamente la habilitación otorgada al establecimiento señalado, hasta tanto la firma realice las correcciones necesarias de acuerdo a las no conformidades informadas oportunamente. Que la suspensión de la habilitación mencionada conlleva al impedimento de elaborar productos veterinarios de cualquier índole. Que el suscripto se encuentra facultado para el dictado del presente acto, conforme lo establecido por el Anexo II del Decreto N° 1585 del 19 de diciembre de 1996, sustituido por sus similares N° 825 del 10 de junio de 2010 y 354 del 04 de abril de 2013, y en ejercicio de las facultades conferidas por las Resoluciones Nros. 2162 del 29 de noviembre de 2000, 257 del 29 de noviembre de 2003 y 424 del 22 de junio de 2010, todas del SERVICIO NACIONAL DE SANIDAD Y CALIDAD AGROALIMENTARIA. Por ello, EL DIRECTOR NACIONAL DE AGROQUÍMICOS, PRODUCTOS VETERINARIOS Y ALIMENTOS DISPONE: ARTÍCULO 1° — SUSPENSIÓN: Suspéndase preventivamente en el Registro Nacional que determina el Artículo 1° del Decreto N° 583 del 31 de enero de 1967, modificado por los Decretos Nros. 3899 del 22 de junio de 1972 y 35 del 11 de enero de 1988, reglamentario de la Ley N° 13.636 y el Artículo 4° del Marco Regulatorio para los productos veterinarios MERCADO COMÚN DEL SUR, puesto en vigencia por la Resolución N° 345 del 6 de abril de 1994 del exSERVICIO NACIONAL DE SANIDAD ANIMAL, la habilitación otorgada oportunamente a favor de la firma REOPEN S.A., correspondiente al Establecimiento N° 8489 sito en la calle Río Derey entre Río Pinto y Río Potrero, General Rodríguez, Provincia de Buenos Aires. ARTÍCULO 2° — VALIDEZ: La suspensión que determina el artículo precedente, tendrá validez hasta tanto la DIRECCIÓN DE PRODUCTOS VETERINARIOS, constate las correcciones de las no conformidades informadas oportunamente. ARTÍCULO 3° — NOTIFICACIÓN: Notifíquese a la firma REOPEN S.A. de lo establecido en la presente Disposición. �ARTÍCULO 4° — VIGENCIA: La presente Disposición entrará en vigencia a partir de la fecha de su notificación por parte de la firma REOPEN S.A.
