RESOLUCION N° 130/1995 IASCAV
Amplíase la Resolución SAGyP Nº 1075/94 por la que se establecieron los distintos rubros para
la comercialización del poroto blanco seleccionado oval y alubia.
BUENOS AIRES, 2 de Octubre de 1995.
VISTO el expediente Nº 1619/93 del registro del INSTITUTO ARGENTINO DE SANIDAD Y
CALIDAD VEGETAL, la Resolución Nº 1075 del 12 de diciembre de 1994 de la SECRETARIA
DE AGRICULTURA, GANADERIA Y PESCA y la presentación realizada por la Cámara de
Legumbres de la REPUBLICA ARGENTINA.
CONSIDERANDO:
Que en el capítulo I Norma XVI, Poroto, Anexo A de la Resolución Nº 1075 del 12 de Diciembre
de 1994 de la SECRETARIA DE AGRICULTURA, GANADERIA Y PESCA, se establecen los
distintos rubros para la comercialización del poroto blanco seleccionado oval y alubia.
Que en las especificaciones comunes a todos los grados de calidad se estableció como
máximo un CINCO POR CIENTO (5%) de porotos blancos de otras clases.
Que los cultivos en la última campaña, han sido afectados por una significativa falta de
precipitaciones, situación ésta que no favoreció el normal desarrollo de las legumbres y motivó
la formación de granos que se manifiestan con diferentes caracteres a las propias de sus tipos.
Que la Cámara agrupa la especialidad solicita por nota la ampliación de la tolerancia para el
rubro “poroto blanco de otras clases”, a fin de contemplar este caso de emergencia en función
de los volúmenes a exportar.
Que el Area Técnica específica del Instituto ha emitido un informe en igual sentido y propone la
fijación de un período que permita los embarques de mercadería con exceso de porotos
blancos de otras clases.
Que el suscripto es competente para dictar el presente acto, en virtud de lo dispuesto por el
artículo 6ª, inciso a)por aplicación del artículo 10, inciso n) del Decreto Nº 2266 del 29 de
octubre de 1991 con la modificación introducida por El Decreto Nº 1008 del 7 de julio de 1995..

EL PRESIDENTE
DEL INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL
RESUELVE:
ARTICULO 1º- Amplíase, en la Resolución Nº 1075 del 12 de diciembre de 1994 de la
SECRETARIA DE AGRICULTURA, GANADERIA Y PESCA, Capítulo I, Norma XVI, Poroto,
Anexo A, Poroto Blanco Seleccionado Oval y Alubia, punto 2.1.4. Porotos blancos de otras
clases, la tolerancia de este rubro hasta un máximo del QUINCE POR CIENTO (15%).
ARTICULO 2º- La ampliación, con carácter de excepción, establecida por el artículo 1º, regirá
hasta el 31 de marzo de 1996 para toda mercadería que se presente para la exportación.
ARTICULO 3º- La presente resolución tendrá vigencia a partir del día siguiente al de su publica
en el Boletín Oficial.
ARTICULO 4º- Comuníquese, publíquese, dése a la Dirección Nacional del Registro Oficial y
archívese.

RESOLUCION Nº 133/1995 IASCAV
Apruébase el Patrón tipo de calidad para la Comercialización del Tabaco Criollo Misionero.
BUENOS AIRES, 2 de Octubre de 1995.
VISTO el expediente Nº 1011/95 del registro del INSTITUTO ARGENTINO DE SANIDAD Y
CALIDAD VEGETAL, las Leyes Nros. 19.800 y 26.291, el Decreto Nº 2266 del 29 de Octubre
de 1991, modificado por sus similares Nros 1172 del 10 de Julio de 1992, 2194 del 13 de
diciembre de 1994 y 1008 del 7 de julio de 1995, y
CONSIDERANDO:
Que es política de la SECRETARIA DE AGRICULTURA, GANADERIA Y PESCA propender al
mejoramiento de la calidad de los productos para el consumo doméstico y el abastecimiento de
los actuales mercados, así como también poder acceder a nuevas demandas internacionales.
Que en ese marco se hace necesario establecer una nueva estrategia en materia de calidad y
clasificación del tabaco, acorde a las mayores exigencias del mercado interno y externo y a las
posibilidades de satisfacerlas por parte del sector productivo.
Que el INSTITUTO ARGENTINO DE SANIDAD Y CALIDAD VEGETAL (IASCAV), por la índole
de sus funciones, entre las cuales se halla la de elaborar y aprobar la calidad de los productos
vegetales, ha consultado a los sectores de la producción, del comercio, de la industria, y de las
entidades auxiliares del sector tabacalero.
Que las partes han acordado un patrón de calidad adecuado a las exigencias del mercado
interno y externo.
Que respetando la característica esencialmente privada de la transacción comercial, se hace
necesario, en los casos de disponerse aportes del FONDO ESPECIAL DEL TABACO. Dar un
marco de equitativa distribución y salvaguarda de la correcta asignación de fondos entre las
distintas provincias productoras.
Que el suscripto es competente para dictar el presente acto, en virtud de lo dispuesto por el
artículo 6º inciso a) del Decreto 2266 del 29 de octubre de 1991, sustituido por el artículo 4º del
Decreto 1008 del 7 de julio de 1995 y sus modificatorios.
Por ello,
EL PRESIDENTE DEL INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL
RESUELVE:
ARTICULO 1º- Aprobar el Patrón tipo de calidad para la comercialización del Tabaco Criollo
Misionero, que como Anexo I y forma parte de la presente resolución.
ARTICULO 2º- El INSTITUTO ARGENTINO DE SANIDAD Y CALIDAD VEGETAL, será el
Organismo de aplicación de la presente resolución y el responsable de la supervisión de su
cumplimiento, pudiendo delegar las funciones de fiscalización en entidades provinciales de
acuerdo a lo previsto en los artículos 5º y 6º del Decreto 2266 del 29 de octubre de 1991.
ARTICULO 3º- La presente resolución regirá para las operaciones de depósito y compraventa
en el ámbito nacional a partir de la cosecha 1994/1995 y será de cumplimiento obligatorio en
los casos de asignación de recursos según lo previsto en el artículo 12 de la Ley Nº 19.800
modificada y restablecida en su vigencia por la Ley 24.291.
ARTICULO 4º- El incumplimiento de la presente normativa hará pasible a los infractores de la
aplicación de sanciones previstas en el artículo 26 de Decreto Nº 2266 del 29 de octubre de
1991.
ARTICULO 5º- Comuníquese, publíquese, dése a la Dirección Nacional del Registro Oficial y
archívese.

TERCERA CLASE:
Hojas bajeras: color castaño; admitiéndose tonalidades claras y oscuras en cualquier
proporción; largo mínimo TREINTA Y CINCO CENTIMETROS (35 cm); ancho mínimo QUINCE
CENTRIMETROS (15 cm); textura delgada; faltante de hoja hasta TREINTA POR CIENTO
(30%); otras características: hojas maduras con cierta resistencia, elasticidad y gomosidad.
CLASE CUARTA:
Hojas de recibo que por sus características no entran en las clases anteriores: color castaño en
sus distintas tonalidades; largo mínimo TREINTA CENTIMETROS (30 cm); ancho mínimo
QUINCE CENTIMETROS (15 cm); faltante de hoja hasta CUARENTA POR CIENTO (40%).
TABACOS CUYOS RECIBOS SE PROHIBE:
1. Clasificación distinta de la detallada como recibo.
2. Tabacos curados con otro sistema que no sea el propio del tipo comercial.
�3. Tabacos conteniendo hojas con trozos de corteza del tallo de la planta.
4. Tabacos con más del VEINTIDOS POR CIENTO (22%) de humedad o mojados
artificialmente.
5. Tabacos excesivamente perforados por la pulguilla.
6. Tabacos con hojas provenientes de brotes.
7. Tabacos enmohecidos, ardidos, podridos, lavados, helados, quemados, verdes en
todas sus tonalidades, etc.
8. Tabacos con presencia de gorgojos en sus distintos estados.
9. Tabacos con presencia de cuerpos extraños como ser: plumas, chalas, hilos, trapos,
piedras, metales, alambres, etc.
10. Tabacos con olores extraños, o sea ajenos al propio del tipo comercial.
11. Se prohíbe la compra de tabaco proveniente de semilla de poblaciones conocidas
como Madera, Lengua de Vaca y similares.
CONDICIONES DE COMERCIALIZACION
1. Se considera faltante de hoja únicamente a los trozos de lámina ausentes, de manera
que si se tratara de cortes sin pérdida de hoja no se tomarán en cuenta.
2. Los tabacos deberán ser entregados en manojos, debiendo estar atados con UNA (1)
hoja de igual clase; no deben hacerse con más de TREINTA (30) hojas, no debiendo
colocar cuerpos extraños (chalas para señalar determinadas clases).
3. Los manojos deberán contener hojas de una misma clase para las TRES (3) primeras
clases. Deberá evitarse la mezcla, o sea la presencia de hojas de otras clases.
