RESOLUCION N° 413/1994 IASCAV
DEROGADA por RS 182/2018
RESUMEN: Aprueba la constitución de una COMISION TECNICA NACIONAL de lucha contra
CARPOCAPSA (Cydia pomonella L:). La misma tendrá como misión programar y coordinar
medidas tendientes a un eficaz control de la plaga así como proponer normas y procedimientos
que coadyuven a ese fin. Está integrada por representantes de: Instituto Nacional de
Tecnología Agropecuaria (INTA), Cámara Argentina de Fruticultores Integrados (CAFI)
Federación de Productores de Río Negro y Neuquén, Centro de Investigación y Asistencia
Técnica de la Industria (CIATI), Facultad de Ciencias Agrarias de la Universidad Nacional del
Comahue, las provincias de Río Negro, Neuquén, Mendoza y La Pampa.
BUENOS AIRES, 2 de noviembre de 1994.
VISTO el expediente N° 2525/94 del registro del INSTITUTO ARGENTINO DE SANIDAD Y
CALIDAD VEGETAL, y
CONSIDERANDO:
Que la “Carpocapsa” (Cydia pomonella L:) constituye una plaga que causa serios perjuicios en
las frutas de pepita dificultando su comercialización interna y externa.
Que existe consenso entre las Instituciones que están abocadas al tratamiento del tema para la
creación de una “Comisión Técnica Nacional” para el control de dicha plaga.
Que el suscripto es competente para dictar el presente acto en virtud de lo dispuesto por los
artículos 6°, inciso j) y 10, inciso n) por aplicación del artículo 11, inciso i) del Decreto N° 2266
del 29 de octubre de 1991, modificado por su similar N° 1172 del 10 de julio de 1992.
Por ello
EL PRESIDENTE DEL INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL
RESUELVE:
ARTICULO 1°.- Aprobar la constitución de una “Comisión Técnica Nacional” que tendrá como
misión de programar y coordinar las medidas y actividades tendientes a un eficaz control de la
plaga “Carpocapsa” (Cydia pomonella,L.) en el ámbito nacional, así como proponer normas y
procedimientos que coadyuven a ese fin.
ARTICULO 2°.- La “Comisión” cuya constitución se aprueba por el artículo 1° estará integrada
por representantes nominados por el INSTITUTO ARGENTINO DE SANIDAD Y CALIDAD
VEGETAL (IASCAV), el INSTITUTO NACIONAL DE TECNOLOGIA AGROPECUARIA (INTA),
las provincias de: RIO NEGRO, NEUQUEN, MENDOZA y LA PAMPA, la CAMARA
ARGENTINA DE FRUTICULTORES INTEGRADOS (CAFI), la FEDERACION DE
PRODUCTORES DE RIO NEGRO Y NEUQUEN, el CENTRO DE INVESTIGACION Y
ASISTENCIA TECNICA DE LA INDUSTRIA (CIATI) y la FACULTAD DE CIENCAS AGRARIAS
DE LA UNIVERSIDAD DEL COMAHUE.
ARTICULO 3°.- Dicha “Comisión” se reunirá dentro de los TREINTA (30) días del dictado de la
presente, en la Sede Central del INSTITUTO ARGENTINO DE SANIDAD Y CALIDAD
VEGETAL.
ARTICULO 4°.- La “Comisión” en su primer convocatoria deberá establecer el reglamento de
funcionamiento y elección de sus autoridades.
ARTICULO 5°.- Facúltase a la “Comisión” a solicitar de los organismos competentes, la
colaboración que considere necesaria para el mejor cumplimiento de sus finalidades.
ARTICULO 6°.- Comuníquese, publíquese, dése a la Dirección Nacional del Registro Oficial y
archívese.

RESOLUCION N° 416/94 IASCAV
RESUMEN: Establece los plazos para la emisión del AFIDI y los Análisis de Riesgo de Plagas.
La Dirección Nacional de Protección Vegetal puede suspender la emisión de los AFIDIs en
caso que se modifiquen las condiciones del lugar de origen o se detecten irregularidades en la
certificación fitosanitaria.
BUENOS AIRES, 4 de noviembre de 1994
VISTO el expediente N° 2356/94 del registro del INSTITUTO ARGENTINO DE SANIDAD Y
CALIDAD VEGETAL y las Resoluciones Nros. 202/92 y 668/94, y
CONSIDERANDO:
Que el artículo 5° de la Resolución N° 202 del 1 de abril de 1992 de la SECRETARIA DE
AGRICULTURA, GANADERIA Y PESCA, establece la obligatoriedad de la Autorización
Fitosanitaria de Importación (AFIDI), para la importación de productos de origen vegetal.
Que el artículo 6° de la Resolución N° 668 del 10 de agosto de 1994 de la SECRETARIA DE
AGRICULTURA, GANADERIA Y PESCA, encomendó al INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL la aprobación y aplicación del procedimiento para la solicitud
y la emisión de la Autorización Fitosanitaria de Importación (AFIDI).
Que la Autorización Fitosanitaria de Importación (AFIDI), establece las condiciones
fitosanitarias que deben cumplir los productos de origen vegetal que se importan para prevenir
el ingreso de plagas cuarentenarias.
Que los requisitos establecidos en la Autorización Fitosanitaria de Importación (AFIDI), son el
resultado del Análisis de Riesgo de Plagas que se efectúa para cada caso, de acuerdo a
estándares internacionales.
Que es necesario ordenar el procedimiento de solicitud y emisión de la Autorización
Fitosanitaria de Importación (AFIDI), para desarrollar un eficiente Análisis de Riesgo de Plagas.
Que es necesario ordenar la operativa administrativa para una mayor transparencia del
procedimiento y una mayor eficiencia en la atención al público.
Que el suscripto es competente para dictar el presente acto en virtud de lo dispuesto por el
artículo 6°, inciso a) del Decreto N° 2266 del 29 de octubre de 1991, modificado por su similar
N° 1172 del 10 de julio de 1992.
Por ello,
EL PRESIDENTE DEL INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL '
RESUELVE:
ARTICULO 1°.- Establecer como plazo de emisión de la Autorización Fitosanitaria de
Importación (AFIDI), por parte de la Dirección de Cuarentena Vegetal el término de CINCO (5)
días hábiles desde la presentación de la solicitud en debida forma. Este plazo se aplicará a las
solicitudes correspondientes a productos vegetales, partes vegetales, tipo de transporte,
destino de la mercadería y origen de la mercadería a los cuales ya se les haya efectuado el
correspondiente Análisis de Riesgo de Plagas.
ARTICULO 2°.- Establecer un plazo mínimo de TRES (3) meses desde la presentación de la
solicitud en debida forma, para la emisión de la Autorización Fitosanitaria de Importación
(AFIDI) de productos vegetales, partes vegetales, destinos y orígenes de la mercadería
respecto de los cuales la Dirección de Cuarentena Vegetal no haya efectuado el Análisis de
Riesgo de Plagas, al momento de la presentación de la solicitud.
ARTICULO 3°.- La Dirección Nacional de Protección Vegetal podrá suspender la emisión de la
Autorización Fitosanitaria de Importación (AFIDI), en aquellos casos en los que las condiciones
fitosanitarias en el lugar de origen de los productos se modifiquen o en los casos en los que se
detecten irregularidades en la certificación fitosanitaria, lo que será comunicado por circular y
expuesto en cartelera.
�ARTICULO 4°.- En aquellos casos en los que como resultado del Análisis de Riesgo de Plagas
se determine que las condiciones fitosanitarias en el país de origen constituyen un riesgo para
la introducción de plagas cuarentenarias a nuestro país, o en los casos en que no se cuente
con suficientes antecedentes técnicos, la Dirección de Cuarentena Vegetal no emitirá la
Autorización Fitosanitaria de Importación (AFIDI) solicitada.
ARTICULO 5°.- En los casos establecidos en los artículos 3° y 4° de la presente resolución, la
Dirección de Cuarentena Vegetal devolverá la solicitud de la Autorización Fitosanitaria de
Importación (AFIDI) al interesado, dentro de los plazos estipulados en los artículos 1° y 2° de la
presente resolución, y notificará al interesado los motivos de la suspensión o no emisión de la
Autorización Fitosanitaria de Importación (AFIDI).
ARTICULO 6°.- La presente resolución entrará en vigencia a partir de los TREINTA (30) días
de su publicación en el Boletín 0ficial.
ARTICULO 7°.- Comuníquese, publíquese, dése a la Dirección Nacional del Registro Oficial y
archívese.
