RESOLUCION N° 224/1995 IASCAV
DEROGADA por RS 481/2014
BUENOS AIRES, 1 de noviembre de 1995
VISTO el expediente NO 3033/94 del registro del INSTITUTO ARGENTINO DE SANIDAD Y
CALIDAD VEGETAL, sobre la fijación de tolerancia de impurezas en principios activos técnicos
químicos, de acuerdo a lo establecido por la Resolución N° 34 del 26 de febrero de 1993 de la
SECRETARIA DE AGRICULTURA, GANADERIA Y PESCA y lo propuesto por el Comité Técnico
Asesor de la Presidencia del INSTITUTO ARGENTINO DE SANIDAD Y CALIDAD VEGETAL, y
CONSIDERANDO:
Que las impurezas presentes en los productos químicos y biológicos de uso agrícola y
perihogareño provenientes de los principios activos técnicos o de los coadyuvantes, sustancias
auxiliares o acompañantes que conforman la formulación pueden producir efectos adversos en la
salud humana o en el medio ambiente como así también afectar nuestro comercio interno o
externo de productos y subproductos del agro.
Que la Resolución N° 34 del 26 de febrero de 1993 de la SECRETARIA DE AGRICULTURA,
GANADERIA Y PESCA establece los requisitos técnicos en materia de impurezas de importancia
toxicológica y ecotoxicológica, para el registro y reevaluación de los insumos químicos y biológicos
de uso agrícola y perihogareño de inscripción obligatoria en el INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL.
Que los artículos 4°, 5° y 6° de la Resolución N° 34 del 26 de febrero de 1993 de la SECRETARIA
DE AGRICULTURA, GANADERIA Y PESCA determinan el mecanismo para la fijación de
tolerancias de impurezas de declaración obligatoria.
Que los contenidos de impurezas y el grado de tolerancia de las mismas en productos técnicos y
formulados agroquímicos y agrobiológicos deben reglamentarse en el ámbito Nacional para
favorecer el comercio interno y externo de insumos de calidad.
Que la sustancia denominada 2,3,7, 8 TCDD: 2, 3, 7, 8 tetraclorodibenzo-p-dioxina, ha sido
identificada como causante de adversidades toxicológicas de importancia lo cual hace necesario su
regulación cualicuantitativa en los principios activos técnicos y formulaciones que la contengan.
Que el suscripto es competente para dictar el presente acto, en virtud de lo dispuesto por los
artículos 6°, inciso b) y 10, inciso n) del Decreto N° 2266 del 29 de octubre de 1991, y sus
modificatorios.
Por ello,
EL PRESIDENTE DEL INSTITUTO ARGENTINO DE
SANIDAD Y CALIDAD VEGETAL
RESUELVE:
ARTICULO 1°.- Declárase a la sustancia 2,3,7, 8 TCDD: 2,3,7, 8 tetraclorodibenzo-p-dioxina
impureza de declaración obligatoria para el registro y reevaluación del principio activo técnico
MCPA.
ARTICULO 2°.- Fíjase para la 2,3,7, 8 TCDD una tolerancia de UN (1) microgramo/kilogramo en el
principio activo grado técnico MCPA.
ARTICULO 3°.- Las empresas cuyos productos se hallan alcanzados por la presente deberán
cumplimentar lo establecido por el artículo 7° de la Resolución N° 34 del 26 de febrero de 1993 de
la SECRETARIA DE AGRICULTURA, GANADERIA Y PESCA.
ARTICULO 4°.- Las personas físicas y jurídicas que tengan registrados principios activos técnicos
y productos formulados que no se ajusten a la presente, deberán declarar al Registro Nacional de
Terapéutica Vegetal los remanentes de tales productos en un plazo de VEINTE (20) días hábiles
administrativos a partir de la vigencia de esta resolución.
�ARTICULO 5°.- Las infracciones a la presente resolución serán sancionadas de conformidad a lo
dispuesto por el artículo 26 del Decreto N° 2266 del 29 de octubre de 1991.
ARTICULO 6°.- La presente resolución tendrá vigencia a partir de la fecha de su publicación.
ARTICULO 7°.- Comuníquese, publíquese, dése a la Dirección Nacional del Registro oficial y
archívese.
