RESOLUCION SENASA RZ 313 95
RESUMEN: Establece la eximición a faena, del pago de arancel por parte de
los acopiadores, dentro del plazo de validez de la constancia de vacunación
(PSTA/DTA) expedida al productor.
BUENOS AIRES, 29-5-1995
VISTO la Resolución 807 del 12 de agosto de 1993, que crea el
Registro de Acopiadores Porcinos e implementa el documento Declaración
Jurada de Acopio de Porcinos, y
CONSIDERANDO:
Que siendo forma común en la comercialización de porcinos la
modalidad de Acopiadores, la cual provoca una pérdida del origen o
procedencia real de los animales acopiados.
Que el Programa Enfermedades de los Porcinos manifiesta que la
puesta en vigencia efectiva de la mencionada Resolución N° 807/93 permitirá
mantener un mayor control sobre los movimientos y tránsito entre las
diferentes zonas de los animales en cuestión.
Que ello permitirá concretar un mejor estudio epidemiológico en caso
de producirse focos de enfermedades infecciosas como la Peste Porcina
Clásica y la Fiebre Aftosa o parasitarias tal como la Triquinelosis,
peligrosísima zoonosis.
Que el instrumento legal mencionado, la Resolución 807/93, hace más
transparente la comercialización y permite agilizar y optimizar el desarrollo de
la actuación sanitaria.
Que el Consejo de Administración del SENASA estima que los cerdos
comercializados a través de acopiadores, con exclusivo destino a faena, estén
exentos del pago de la Declaración Jurada de Acopio, siempre y cuando la
faena se realice dentro del plazo de validez de la Constancia expedida al
productor.
Que la Subgerencia de Asuntos Jurídicos ha tomado la intervención
que le compete.
Que el suscripto se halla facultado para dictar la presente en virtud de
lo dispuesto por el artículo 33 del Reglamento de la Ley 23.899, aprobado por
Decreto n° 1553 del 12 de agosto de 1991.
Por ello,
�EL ADMINISTRADOR GENERAL DEL SERVICIO NACIONAL DE
SANIDAD ANIMAL
RESUELVE:
ARTICULO 1°.- Los Acopiadores que comercialicen porcinos con exclusivo
destino a faena, deberán presentar los originales de la Constancia de
Vacunación y del arancel, que oportunamente fuera obtenido por el productor.
Dichas Constancias quedarán adjuntas en el triplicado de la Declaración
Jurada de Acopio, quedando eximido del pago siempre y cuando la faena se
produzca dentro del plazo de validez de la Constancia expedida al productor.
ARTICULO 2°.- El Acopiador concurrirá a la Delegación correspondiente de
la GERENCIA DE LUCHAS SANITARIAS, con los originales de la/s
Constancia/s de Vacunación y el Arancel de cada uno de ellas, donde se le
confeccionará la planilla de Declaración Jurada de Acopio, en la que se
consignarán todos los datos correspondientes a los propietarios de los porcinos
comercializados con exclusivo destino a faena.
ARTICULO 3°.- La Declaración Jurada de Acopio carecerá de validez si no
va acompañada por la Guía de Campaña o Permiso de Tránsito respectivo.
ARTICULO 4°.- La falta de uno solo de los requisitos expresados en los
Artículos 1° y 2° de esta Resolución, sin excepción, dejará sin efecto lo
resuelto en la presente, debiendo el Acopiador cumplir con los pagos
correspondientes de acuerdo a las normas vigentes.
ARTICULO 5°.- Comuníquese, publíquese, dése a la DIRECCION
NACIONAL DEL REGISTRO OFICIAL y archívese.
